APPROVAL OF MINUTES ITEM 1: Minutes of the regular Planning Commission Meeting of May 7, 2003. CONSENT CALENDAR There were no Consent Calendar items. PUBLIC HEARINGS ITEM 2: Coastal Development Permit CDP03-03 to allow construction of a 4,719 square foot single-family residence, with bluff edge setback deviation, on a 9,359 square foot site located at 35321 Camino Capistrano in the Capistrano Beach area of the City. (FF# 0610-70/CDP03-03/Camino Capistrano, 35321) [AA] Applicant/ Owner: Harley C. Payne Location: 35321 Camino Capistrano Environmental: This project is categorically exempt, Section 15303 (Class 3 New Construction or Conversion of Small Structures) from provisions set forth in the California Environmental Quality Act (CEQA), in that it involves construction of a new single-family residence not in conjunction with construction of three or more such dwelling units. Recommendation: That the Planning Commission adopt the attached draft Resolution approving Coastal Development Permit CDP03-03 for construction of a single-family residence on a bluff-top lot with setback deviation from the coastal bluff edge. Albert Armijo (Planning Consultant) reviewed the staff report. Chairman Schoeffel opened the Public Hearing. Harley Payne (San Clemente Property Owner) felt that he had done everything to complete the project and to comply with all of the Citys requirements. He asked for approval of the project as proposed. Kevin Trigg (San Clemente Geofirm) stated that he was available to answer any technical questions the Commission might have on the project. James Staley (Capistrano Beach) stated that he was concerned with the following: Accurate identification of the closest edge of the bluff. Concept of caissons, rebar, concrete, and a fireplace out on the edge. Capistrano Formation is not bedrock. View blockage. Future enclosure of the patio as habitable space. Felt that approval of the project as proposed would set precedent. He asked the Commission to not approve the deviation. Kerry Staley (Capistrano Beach) felt that by allowing the deviation for this project that it would encroach on their feeling of space, the stability of the bluff and their view. She stated that the plan should not even be considered as proposed. She added that as proposed, the habitable structure would extend out six feet beyond the rear wall of her home and that the patio structure would add another fifteen feet. Eugenia Garcia (Acting Director) clarified that the geotechnical studies are done on a case-by-case basis to establish where the top of bluff is for each particular lot. JoAnn Udall (Capistrano Beach) felt that the project as proposed would pose a danger to the adjacent properties. She stated that the construction of a patio, balcony cover and fireplace within twenty-five feet of the bluff will decrease the value of her home because it will block her view looking towards Dana Point and the harbor. She added that the increased weight near the bluffs edge could some day take everyone down. Kerry Staley stated that the two lots were almost identical and that the reason they had chosen their lot was that it had less erosion and more of a bluff edge. She added that they do not agree with the applicant on where they have determined the bluff edge is located. Harley Payne introduced pictures to the Commission showing the layout for the patio structure and stated that he was not encroaching out any further onto the bluff than what the Staleys had already done. Kevin Trigg stated that the Hannan report for the Staleys property was reviewed by his company and that when they drilled in March 2002 they did not find any water. He added that in the Hannan report, they had drilled in April 1998 and that the 97/98 winter was an El Nino winter. He stated that they were proposing to take the load of the structure and bury into the hillside using the caisson design. He added that the actual frame of the caisson construction would enhance the stability of the zone above. Chairman Schoeffel closed the Public Hearing. Vice-Chairman Denton stated that he could not support the project as proposed. He added that he would consider approving a deviation of less than half of what the City has recommended and for the house to be moved closer to the street. He felt that the project would be too close to the bluff edge with a fireplace and patio. Commissioner OConnor stated that she was concerned with the closeness to the bluff edge and the possibility of future enclosure of the patio. She added that since the applicant does have thirteen feet in the front, she would like the house to be moved closer to the street and further away from the edge of the bluff in the back. Albert Armijo replied that the requirement of the code for the setback is ten feet; however there is also a requirement to have a twenty-foot driveway. He added that the structure could only be moved three feet towards the street unless a variance was granted for the front setback. Commissioner Powers stated that he understands caissons and how they work. He added that the City needs to rely on the geotechnical consultants to identify the top of bluff. He was concerned with drainage and the future possibility of enclosing the patio to create more living space. Chairman Schoeffel felt that the Commission couldnt deny this project. He stated that the project had undergone a tremendous amount of study and that the applicant had complied with the requirements in place. Commissioner Weinberg felt that the Commission must depend on the experts when determining bluff edge setbacks. ACTION: Motion made (Powers) and seconded (OConnor) to adopt Resolution 03-05-07-23 approving Coastal Development Permit CDP03-03. Motion carried 4-1.
